Broker Lynn Simon Barred by FINRA

Lynn SimonAccording to records provided by the Financial Industry Regulatory Authority (FINRA), former Indiana-based CFD broker Lynn Simon has been permanently barred from acting as a broker, or otherwise associating with firms that sell securities to the public. The securities and investment fraud law firm Fitapelli Kurta is interested in speaking to investors who have complaints regarding Ms. Simon (CRD# 729413).

Lynn Simon has spent 31 years in the securities industry and was most recently registered with CFD Investments in Evansville, Indiana (2008-2013). Previous registrations include Capital Select Investments in Evansville, Indiana (2006-2008); American General Securities in Houston, Texas (2004-2005); American General Securities in Phoenix, Arizona (1999-2003); Securities America in La Vista, Nebraska (1989-1999); American General Securities (1986-1989); Equico Securities (1985); and the Equitable Life Assurance Society of the United States (1981-1985). She is currently not registered with any state or firm.

According to her BrokerCheck report, Lynn Simon is the subject of two customer complaints, one regulatory sanction, and one pending regulatory investigation. She was also discharged from her position at CFD Investments.

In 2014 a customer alleged Lynn Simon, while employed at American General Securities, recommended unsuitable investments, breached contract, violated the Indiana Securities Act, breached her fiduciary duty, acted negligently, and engaged in negligent supervision. The complaint settled in 2015 for $10,000.

In 2013 a customer alleged Lynn Simon, while employed at CFD Investments, sold unsuitable investments, engaged in negligent account management, misrepresented material facts related to an investment, violated the Indiana Securities Act, breached contract, breached her fiduciary duty, and violated FINRA and New York Stock Exchange Rules. The complaint settled in 2015 for $247,850.

In 2013 FINRA sanctioned Lynn Simon following allegations she failed to respond to a request for information. Ms. Simon was permanently barred from associating with any FINRA member firm in any capacity.

In 2013 the Indiana Securities Division launched an investigation into Lynn Simon’s “activities surrounding Financial Planning, Inc.” The investigation remains pending.
