Mitchell Foote: Complaint for REIT Investment

According to his BrokerCheck report, Mitchell Foote is the subject of one customer complaint, one pending customer complaint, and two denied customer complaints.

  • In 2014 a customer alleged Mitchell Foote, while employed at Broker Dealer Financial Services, recommended an investment in a Behringer Harvard 1 real estate investment trust (REIT) that now has “no value.” The customer is seeking $30,000 in damages in the pending complaint.
  • In 2011 a customer alleged Mitchell Foote, while employed at SII Investments, misrepresented and recommended unsuitable investments in REITs. The complaint settled for $44,000, to which Mr. Foote individually contributed $44,000.
  • In 2010 a customer alleged Mitchell Foote, while employed at SII Investments and Broker Dealer Financial Services, misrepresented and recommended an unsuitable investment. The customer sought damages exceeding $30,600 in the complaint, which was denied.
  • In 2004 a customer alleged Mitchell Foote, while employed at InterSecurities, misrepresented material facts related to an investment. The customer sought $45,000 in damages in the complaint, which was denied.
