James Protigal Has Variable Annuity Complaints

James ProtigalPublicly available records provided by the Financial Industry Regulatory Authority (FINRA) on August 23, 2016 indicate that former Florida-based Investors Capital broker James Protigal has been the subject of customer complaints. James Protigal has spent 24 years in the securities industry and was most recently registered with Investors Capital in Nokomis, Florida (2016). Previous registrations include Sagepoint Financial in Nokomis, Florida; Prime Capital Services in Nokomis, Florida; SII Investments in Appleton, Wisconsin; Southern Capital Securities in Tampa, Florida; Princor Financial Services in Des Moines, Iowa; Pruco Securities in Newark, New Jersey; and Waddell & Reed in Overland Park, Kansas. He is currently not registered with any state or firm.

According to his BrokerCheck report, James Protigal has been the subject of five customer complaints.

In 2011, a customer alleged James Protigal, while employed at Prime Capital Services, did not inform them of the differences between fixed and variable annuities. The complaint settled in 2012 for $90,000, to which Mr. Protigal individually contributed $47,500.

In 2009, a customer alleged James Protigal, while employed at Prime Capital Services, executed an unauthorized purchase of a Highland Senior floating rate. The complaint settled for $6,000, to which Mr. Protigal individually contributed $5,700.

In 2008, a customer alleged James Protigal, while employed at Prime Capital Services, made an unsuitable variable annuity investment. The complaint settled for $3,500, to which Mr. Protigal individually contributed $2,100.

In 2006, a customer alleged James Protigal, while employed at Prime Capital Services, sold an unsuitable variable annuity. The complaint settled for more than $3,700.

In 1994, a customer alleged James Protigal, while employed at Prudential Insurance, misunderstood the client’s wishes in the sale of a variable appreciable life contract and two mutual funds. The complaint settled for $100,000.
