In November 2016 FINRA named Michael Mason respondent in a complaint alleging he “failed to appear for on-the-record testimony pursuant to an investigation into the circumstances of his termination from a member firm as set forth in his Form U5.” The complaint remains pending, though in March 2017 FINRA rendered a default decision “wherein Mason was barred from association with any FINRA member in any capacity.” According to FINRA’s statement: “The sanction was based on findings that Mason failed to appear twice for FINRA on-the-record testimony in connection with an investigation into the circumstances of his termination from his member firm as indicated on his Form U5 filed with FINRA. The findings stated that the Form U5 indicated that Mason was permitted to resign and that Mason falsified client information to open seven new firm accounts and provided the firm with inaccurate information during an internal review.” The statement concludes that “If no further action is taken, [the] decision will become final April 3, 2017.”
