In July 2016 FINRA sanctioned Pascal Besman following allegations he “failed to timely disclose a compromise with a creditor on his Form U4.” According to FINRA’s findings: “Besman entered into a compromise with a creditor through which he agreed to pay $175,000 to satisfy a debt in connection with a FINRA arbitration award. The compromise with the creditor required disclosure on Besman’s Farm U4 beginning 30 days after learning of the facts and circumstances giving rise to the amendment; however, he did not make the required disclosure on his Form U4 until over two years after.” He was issued a 3-month suspension and a fine of $10,000.
In 2010 a customer alleged Pascal Besman, while employed at ThinkEquity and JMP Securities, committed fraud, negligently misrepresented and omitted material facts, and breached his fiduciary duty. The complaint resulted in an award to the customer of $1,475,000.
