Toby Emmings Permanently Barred

Toby Emmings Public records provided by the Financial Industry Regulatory Authority (FINRA) on April 27, 2016 indicate that former New York-based Cambridge Investment Research broker Toby Emmings has been permanently barred from acting as a broker or otherwise associating with firms that sell securities to the public. Toby Emmings has spent 25 years in the securities industry and was most recently registered with Cambridge Investment Research in Rochester, New York (2008-2014). Previous registrations include Gunnallen Financial in Rochester, New York; Prudential Securities in New York, New York; Dean Witter Reynolds in Purchase, New York; Lehman Brothers in New York, New York; and Thomas James Associates, which has since been expelled by FINRA, in Rochester, New York. He is currently not registered with any state or firm.

According to his BrokerCheck report, Toby Emmings is the subject of two regulatory sanctions and three customer complaints.

In 2014, a customer alleged that Toby Emmings, while employed at Cambridge Investment Research, misrepresented material facts related to the account. The complaint settled for $195,010, to which Mr. Emmings individually contributed $195,000.

In 2014, a customer alleged that Toby Emmings, while employed at Cambridge Investment Research, breached his fiduciary duty, acted negligently, breached contract, and engaged in unjust enrichment. The complaint settled in 2015 for $33,000.

In 2014, FINRA permanently barred Toby Emmings following allegations that he failed to respond to a request for information.

In 2006, the State of New York Insurance Department fined Toby Emmings $750 following allegations that he “demonstrated incompetency to act as an insurance agent and/or broker.”

In 2002, a customer alleged Toby Emmings, while employed at Prudential Securities, recommended unsuitable investments. The complaint settled in 2003 for $175,000.
